Automatic Temporary Restraining Orders
An automatic temporary restraining order (ATRO) is an order on the back of
the divorce petition that attaches to the divorce proceedings. It generally
applies to both spouses and takes effect when the divorce petition is served.
This kind of restraining order prevents either party from moving children
out of state, changing insurance beneficiaries or hiding or liquidating marital
assets.
Temporary Restraining Order
Other temporary restraining orders can be put in place to protect both parties
from each other prior to a restraining order hearing. These orders can include
a temporary change in child custody or
visitation.
Similar restraining orders can be used to prohibit one spouse from negatively
affecting another spouse's business during the divorce, such as preventing
a spouse from misusing clients, partners or financial assets.
Civil Harassment Restraining Orders
Have you received annoying phone calls at home or been subjected to harassment
at work? If you are being stalked, harassed, threatened or sexually assaulted
by someone who is not a close relative and who you have not dated, you may
be able to obtain a civil harassment restraining order. This type of restraining
order prevents someone from contacting you for up to three years.
Domestic Violence Restraining Orders
Like a civil restraining order, a domestic violence restraining order can
last up to three years and completely prevent someone from contacting you.
You can ask for a domestic violence restraining order to protect you and
your family from a close relative (such as spouse, boyfriend/girlfriend,
parent, sibling).
